Terms governing use of the Loaderhouse platform in India

These Terms of Use govern access to and use of the Loaderhouse website, applications, logistics platform, and related services made available in India by N & M KANYSHA LOGISTICS LLP under the Loaderhouse brand.

Important: These terms are intended to protect Loaderhouse as a launch-stage logistics platform. Specific products, business accounts, or partner relationships may also be subject to additional written policies, service-specific rules, invoices, or contracts.

1. Acceptance Of Terms

By accessing or using Loaderhouse, you agree to be bound by these Terms of Use, our Privacy Policy, and any service-specific rules, policies, or instructions we make available from time to time. If you do not agree, you must not use Loaderhouse.

2. Eligibility And Authority

You may use Loaderhouse only if you are legally capable of entering into a binding arrangement under applicable law. If you use Loaderhouse on behalf of a company, partnership, proprietorship, or other organization, you represent that you are authorized to bind that entity to these terms.

3. Scope Of Services

Loaderhouse may provide or facilitate access to logistics, pickup, delivery, fleet management, scheduling, tracking, partner coordination, lead intake, support, and related technology services in India. Services may vary by location, shipment type, partner availability, operational capacity, and compliance requirements. We may add, change, suspend, restrict, or discontinue any feature or service at any time.

4. Accounts And Platform Use

  • You must provide complete, current, and accurate information.
  • You are responsible for activities occurring through your account, login, device, or authorized users.
  • You must maintain the confidentiality of credentials and promptly notify us of suspected unauthorized use.
  • You may not misuse the platform, interfere with operations, reverse engineer restricted systems, or use Loaderhouse for unlawful purposes.

5. Booking Requests And Service Availability

A booking request submitted through Loaderhouse is not guaranteed to be accepted, fulfilled, or completed on any particular timeline. Acceptance depends on operational constraints, serviceability, route conditions, inventory of delivery partners or vehicles, compliance review, weather, strikes, outages, traffic, local restrictions, force majeure events, and other factors beyond our reasonable control.

6. Customer Responsibilities

You are solely responsible for ensuring that:

  • shipment descriptions, declared value, dimensions, weight, quantity, addresses, and contact details are accurate;
  • goods are lawfully owned, transferable, and permitted to be transported;
  • items are properly packed, labelled, documented, and prepared for safe handling and transit;
  • all permits, invoices, e-way bills, tax documents, licenses, declarations, and consents required by law are obtained and valid;
  • recipients are available and authorized to receive goods where applicable.

7. Prohibited And Restricted Shipments

You must not use Loaderhouse to request, arrange, store, or transport any item that is unlawful, unsafe, restricted without proper authorization, or otherwise unsuitable for our services. This includes, by way of example, explosives, weapons, ammunition, narcotics, illegal drugs, live animals, human remains, hazardous chemicals, counterfeit goods, stolen goods, cash beyond lawful or operational limits, high-risk valuables, and any item prohibited by law, policy, carrier restrictions, or local authority instructions.

We reserve the right to refuse, inspect, hold, report, remove, cancel, or dispose of any shipment where we reasonably suspect a violation of law, safety requirements, or these terms, without liability to you except to the extent required by law.

8. Pricing, Charges, And Payment

  • Prices, estimates, and quoted charges may depend on route, timing, vehicle type, weight, dimensions, waiting time, tolls, taxes, surcharges, and other operational factors.
  • Quoted or displayed prices may be revised if shipment details are incomplete, inaccurate, or materially different from the actual service requirement.
  • You authorize Loaderhouse to collect due amounts through the selected payment method or other agreed recovery channels.
  • Unless otherwise agreed in writing, fees paid are non-refundable except where required by law or expressly approved by Loaderhouse.

9. Cancellations, Failed Deliveries, And Delays

Cancellation charges, return charges, waiting charges, reattempt charges, or other fees may apply depending on the operational stage of the booking and the reason for cancellation or failure. Delivery times, ETAs, and service windows are estimates only and not guaranteed. Loaderhouse is not responsible for losses arising from delays, failed pickups, failed deliveries, or interruptions caused by circumstances beyond our reasonable control or by user-supplied errors.

10. Third-Party Service Providers And Partners

Loaderhouse may engage or facilitate third-party carriers, fleet owners, independent drivers, payment processors, software vendors, verification providers, or other partners. Availability of the platform does not mean that any third party is our employee or agent for all purposes. To the maximum extent permitted by law, Loaderhouse is not responsible for separate acts or omissions of third parties except as expressly required under applicable law or a written agreement.

11. Intellectual Property

Loaderhouse, its content, software, branding, logos, interfaces, workflows, documentation, and related materials are owned by or licensed to N & M KANYSHA LOGISTICS LLP and are protected by applicable intellectual property laws. Except for limited use necessary to access the services, no right, title, or license is granted to you.

12. Disclaimers

Loaderhouse is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that the services will always be uninterrupted, secure, timely, accurate, error-free, suitable for every use case, or available in every location. Shipment handling, delivery timing, and operational outcomes depend on multiple variables and cannot be guaranteed unless expressly agreed in writing.

13. Limitation Of Liability

To the fullest extent permitted by applicable law, Loaderhouse and N & M KANYSHA LOGISTICS LLP shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential losses, including loss of profit, business interruption, goodwill loss, data loss, or loss arising from delay, non-delivery, misdelivery, platform downtime, or third-party conduct.

To the fullest extent permitted by law, Loaderhouse’s aggregate liability arising out of or relating to the services shall not exceed the lesser of the fees actually paid to Loaderhouse for the specific booking giving rise to the claim or INR 5,000, unless a different liability limit is expressly stated in a written contract signed by Loaderhouse.

14. Claims Process

Any claim relating to a booking, shipment, payment, or service issue must be reported to info@loaderhouse.com with sufficient supporting details within 7 days of the event giving rise to the claim, failing which the claim may be rejected to the extent permitted by law. Submission of a claim does not guarantee acceptance, compensation, or waiver of any defense available to Loaderhouse.

15. Indemnity

You agree to defend, indemnify, and hold harmless Loaderhouse, N & M KANYSHA LOGISTICS LLP, and their affiliates, partners, personnel, and representatives from and against claims, proceedings, penalties, losses, damages, liabilities, costs, and expenses arising out of or relating to your breach of these terms, unlawful conduct, inaccurate declarations, prohibited shipments, failure to comply with law, or infringement of rights of any person.

16. Suspension And Termination

We may suspend, restrict, investigate, or terminate access to Loaderhouse at any time, with or without notice, where we believe it is necessary to protect the platform, comply with law, address risk, prevent abuse, respond to non-payment, or investigate suspected misconduct. Rights and obligations that by their nature should survive termination will survive.

17. Governing Law And Jurisdiction

These Terms of Use are governed by the laws of India. Subject to applicable law, courts located in Delhi shall have exclusive jurisdiction over disputes arising out of or relating to Loaderhouse or these terms.

18. Changes To Terms

Loaderhouse may modify these terms from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of Loaderhouse after such changes means you accept the revised terms to the extent permitted by law.
